Disclosure

Depending on size and legal form, certain financial data such as balance sheets, notes, etc. must be disclosed or deposited in the Federal Gazette. At www.unternehmensgegister.de, anyone can find out about the data disclosed in the electronic business register.

If the disclosure does not take place within 12 months of the end of the financial year, sensitive fines will be imposed after a short reminder period. In the case of non-capital-market-oriented companies, these range from € 2,500 to € 25,000 and can be set several times until disclosure has taken place. In the case of capital market oriented companies, even up to €10 million or 5% of total annual turnover, or twice the economic benefit derived from non-disclosure. The Federal Office of Justice is responsible for this.
